- The termination of a contract by performance in accordance with its terms. 17 Am J2d Contr § 482. Released from performance of duty; dismissed from employment; released from one of the armed services. 36 Am J1st Mil § 36. A convict is "discharged" from prison when he is restored to freedom. It may not mean that he has been given the right of suffrage, or the right to hold office, if he lost those rights by conviction, but it does mean that in all other respects he is a citizen, and fully protected in his rights under the organic law. Ex parte Schatz, 307 Mo 67, 269 SW 383, 38 ALR 1032, 1035. As the word is used in a statute exempting a person from jury service who has been "discharged" as a juror within a year, it means one who is discharged from the panel, or for the term, and not one who has been discharged from a case at the close of a trial. White v United States (CA9 Cal) 16 F2d 870.
