agreed statement of facts

A statement agreed or stipulated by respective counsel as being the facts of the case. It is but a substitute for the evidence of those facts and in this respect an agreed statement of fact differs from an agreed case, which may be submitted for decision without any pleadings. Towle v Sweeney, 2 Cal App 29, 83 P 74. According to some authorities, signatures of the parties or their attorneys is unnecessary to an agreed statement of facts admitted by the parties to be true in open court. Le Barron v Harvard, 129 Neb 460, 262 NW 26, 100 ALR 767.
