alteration of instrument
- A change in the sense or language of the instrument effected by an intentional act performed on the instrument by a party entitled to the instrument. In the legal sense of the term "alteration of instrument" it does not include an act performed on the instrument by a stranger thereof. 4 Am J2d Alt of Inst § 1. In order to constitute a forgery, an alteration must be such as to make the instrument speak a language different in legal effect from that which it originally spoke, or which carries with it some change in the rights, interest, or obligations of the parties to the writing. 23 Am J2d 683 Forg § 16. As to what constitutes an alteration of a will, see Anne: 34 ALR2d 626. See erasure; obliteration; spoilation.
