- A familiar phrase in statutes respecting the rights of pretermitted children. As the expression is used in a statute providing that if a testator "omits to provide" in his will for his child, the child will take as if the testator had died intestate, it means simply an omission to make a provision for the child in the will, and has no reference to the pecuniary value of such provision, the object of the statute being merely to prevent the child from being overlooked.
